Surveys Act Gambit – The Appeal is In

Two of the respondents, previously acting through one lawyer, have brought separate appeals through separate lawyers.  To clarify, one party is using the same lawyer as at the hearing, the other has hired a separate lawyer.

Problem is that they started the appeals in separate courts!  One in Toronto (in my view the wrong place pursuant to the Rules) the other in Newmarket (in my view the correct locale).

They are not doing anything wrong by appealing.  It is a right given to them under the legislation.  It does cause the matter to drag on even longer.  Considering that the origins of the dispute go back to about 1995/96, this needs to be brought to an end.
